We require any major credit card to verify the customer’s payment ability prior to bidding. During the process of bidder verification, a hold will be placed on the customer’s credit card. Upon the conclusion of the sale the winning bidder’s credit card will also be used for payment if the total amount of purchase is less than $750 dollars. If the customer wishes to pay in the form of a cashier’s check, bank wire, or personal check, prior arrangements can be made prior to or after the close of auction by contacting ALCO. In the event of non-payment, the customer’s credit card will be used to collect a forfeiture fee of 15% of the final sales amount in the event of non-payment for any reason. Customers can arrange specific payment types by calling ALCO prior to or during the bidding process at 605-692-2525 during normal business hours, or can be directed to info@advantagelandco.com on weekends or weekdays after 5pm CST. If a customer elects to pay with their site-registered credit card or if the total amount is less than $750 dollars, usually no other action is required on the part of the customer. If paying by check, checks must be made out and addressed to: Advantage Land Company, 510 Main Avenue, Suite 4. Brookings, South Dakota 57006. When paying by cashier’s check, bank wire, or personal check, a customer’s credit card will only incur an actual charge in the event of non-payment. However, in the interim while waiting for satisfactory payment in the form of a check, a hold will be placed on the customer’s credit card. This hold will be lifted once payment has been successfully remitted. If the customer is the winning bidder and chooses to pay in the form of a check, payment must be remitted in the form of a cashier’s check, bank wire, or personal check in the full amount, to include applicable taxes and other fees within seven (7) BUSINESS days. If non-payment exists after seven (7) business days from receipt of invoice, ALCO reserves the right to cancel said order and collect 15% of the total sales amount, to include all taxes and other applicable fees. Customer agrees and acknowledges that non-payment exceeding 7 business days may be the result of delays in their ability to obtain financing, and/or any other extenuating circumstances to include banking delays, acts of God, and other unforeseen circumstances. ALCO charges a 3% processing fee for all credit card purchases. ALCO charges a $30.00 returned check fee.

Hay and Grass Pickup Instructions Customer agrees and acknowledges that all hay, grass, or other related goods purchased on the site are sold “WHERE-IS” unless otherwise explicitly stated. By bidding, the Customer agrees and acknowledges that he/she is responsible for the transportation of hay and/or grass off the original owner’s premises within the 72 hour alloted timeframe from the receipt of invoice. Removal of hay/grass from original owner’s premises shall be at the expense, liability, and risk of the customer. Purchases will be available for pick up only on presentation of paid bill and with the express approval of ALCO. ALCO shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing or reselling at the expense and risk of the Customer any hay or grass purchased and not picked up within the specified time allotted. Unless otherwise explicitly stated, all hay and grass sales must be picked up within 72 hours. The Customer assumes all risk and liability when removing hay and/or grass from the original owner’s premises. This risk and liability includes, but is not limited to: damage of property owned by either original owner or Customer, bodily injury of either original owner or the Customer, and any/all other damages, injuries, loss of equipment, business losses, monetary losses, or loss of life during the course of hay/grass removal from original owner’s property. Absolutely no returns on hay or grass sales. All hay and/or grass lots are sold “AS-IS” and “WHERE-IS” unless otherwise explicitly stated. By bidding the customer assumes all risk and liability for the condition, wear, quality, and appearance of the hay or grass in question. Customers are encouraged to ask questions of the owners when they feel it warranted. The customer assumes all responsibility in ensuring that the hay and/or grass they are bidding on meets their standard of appearance and quality. Persons attending during exhibition, sale, transportation of hay and/or grass, or removal of goods assume all risks of damage of or loss to person and property and specifically release ALCO from liability. Neither ALCO nor its partnering sellers shall be liable by reason of any defect in or condition of the premises on which the sale is held. ALCO assumes no responsibility in the event that damage is caused to property or equipment during hay or grass removal.

 

OTHER TERMS

Orders are not binding upon Advantage Land Company (ALCO) or G3 Auction LLC until accepted by ALCO/G3 Auction LLC. Invoices are due and payable the next business day following the close of auction by 4pm CST unless otherwise explicitly mentioned in Auction Details and/or Payments. The Customer is responsible for sales tax, applicable fees, and all other taxes associated with the order. ALCO/G3 Auction LLC collects South Dakota sales tax on the total purchase price, which includes the buyer premium. ALCO/G3 Auction LLC requires any major credit card to verify the customer’s payment ability prior to bidding. If the total amount of the sale is less than $750 dollars this credit card will also be used to pay for the item(s).  Any transactions greater than $750 dollars can be paid with an E-check, bank wire, cashier’s check, or cash. When paying by check or cashier’s check or bank wire, a customer’s credit card will only incur an actual charge in the event of non-payment. Customers can arrange specific payment types by calling ALCO/G3 Auction LLC prior to or during the bidding process at 605-692-2525 during normal business hours, or can be directed to info@advantagelandco.com on weekends or weekdays after 5pm CST. If you are from another country, you must pay in US funds.  

Failure to pay by the payment deadline noted in these terms and conditions will result in an additional forfeiture fee equal to 15% of the winning bid price plus storage fees of $25/day until the asset is ultimately removed from the auction site. ALCO/G3 Auction LLC reserves the right to charge the credit card on file. After the payment deadline ALCO/G3 Auction LLC may also declare the asset abandoned resulting in additional costs and potential losses to the buyer. ALCO/G3 Auction LLC reserves the right to cancel said if invoices are not paid according to terms. Defaulting customers will lose all bidding privileges with ALCO/G3 Auction LLC .

 

ALCO/G3 Auction LLC  charges a $30.00 returned check fee and no stop payments will be honored.

 

Customer agrees and acknowledges that all purchases on the website are sold “AS-IS” and “WHERE-IS” unless otherwise explicitly stated. In cases where the lot explicitly states that the item can be shipped, customer agrees to pay all applicable shipping costs and fees related to shipment of the item(s). Removal of property shall be at the expense, liability, and risk of the customer. Purchases will be available for pick up only on presentation of paid bill. ALCO/G3 Auction LLC shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing or reselling at the expense and risk of the customer any article purchased and not picked up within the specified time allotted. NO LOT OR ITEM MAY BE TAKEN FROM ORIGINAL OWNER PREMISES UNTIL PAYMENT HAS BEEN RECEIVED IN THE FULL AMOUNT TO ALCO/G3 AUCTION LLC. The Customer assumes all risk and liability when removing equipment from the original owner’s premises. This risk and liability includes, but is not limited to: damage of property owned by either original owner or Customer, bodily injury of the Customer, and any/all other damages, injuries, loss of equipment, business losses, monetary losses, or loss of life during the course of equipment removal. All customers release ALCO/G3 Auction LLC from liability and neither ALCO/G3 Auction LLC nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.

 

Absolutely no returns on sales. All sales are final. By bidding the customer assumes all risk and liability for the condition, wear, quality, and appearance of the item. The customer assumes all responsibility in ensuring that the item they are bidding on meets their standard whether inspected in person or online. ALCO/G3 Auction LLC reserves the right to withdraw or relist an item. ALCO/G3 Auction LLC reserves the right to re-open the bid as a result of discrepancies in the bidding process. ALCO/G3 Auction LLC reserves the right to sell items absolute or with a reserve at their client’s discretion. Any ready, willing and able buyer has the right to bid, including the seller and ALCO/G3 Auction LLC on behalf of the seller. The decision of ALCO/G3 Auction LLC shall be final and absolute in the settling of any/all disputes that may arise before, during, or after the auction process. ALCO/G3 Auction LLC shall not be responsible for the correct description, authenticity, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made, or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged items.  Announcements made day of the sale take precedence over all written material.
